• • These General Terms and Conditions of Sale (GTCS) apply to all services, orders and shipments of goods that you, as a customer, order from CARAT DIAMOND, the seller, on its website,  https://caratdiamond.ch. By placing an order, you acknowledge having read, understood and accepted these T&Cs without reservation.
  • CARAT DIAMOND reserves the right to modify these T&Cs at any time by publishing a new version on the Site. Any order placed after the publication of the new version of the GCS implies acceptance of these.
  • By using the https://www.caratdiamond.ch website, , you also agree to be bound by its Terms of Use and our Privacy Notice. Please read them carefully.

REGISTRATION AND CUSTOMER ACCOUNT

• • If you open a customer account with us, you are responsible for ensuring that the personal data you have provided is true, accurate and up-to-date before placing an order. Please ensure that the password chosen during your registration remains confidential and that it is not disclosed to anyone. 
  • We reserve the right to refuse to provide service and/or close an account without notice if it violates these Terms or if we decide it is in the best interest of CARAT DIAMOND.

• • All orders placed by the Buyer imply full and unreserved acceptance of these General Terms and Conditions of Sale.

ORDER CONFIRMATION

• • By placing an order on our Site, you agree to purchase the products you have selected in accordance with these General Conditions of Sale.
  • We offer our products for sale on our site within the limits of available stocks.

PRICES AND TAXES

• • Prices are quoted in Swiss francs (CHF) and apply to products on offer at the time you place your order. They include Swiss VAT by default.
  • The customer is responsible for the cost of delivery of the items ordered, including postage and packaging. They are calculated individually based on the number of suppliers, weight and size of the order. Delivery costs are indicated before the order is placed.
  • CARAT DIAMOND reserves the right to modify its prices and processing and shipping costs at any time and to cancel a contract that contains errors of wording, printing or calculation.

PAYMENT

• • Credit card payment is due immediately. Your credit card data is encrypted for security reasons.

DELIVERY

• • • Your order will be delivered to the delivery address you have given us. Responsibility for the goods will pass to you upon receipt by the shipping company.
  • • CARAT DIAMOND makes every effort to ensure prompt delivery.
  • • Deliveries can only be made within Switzerland.

GOODS CHECK

• • You are required to check the quantity and the good condition of the goods upon delivery. In the event of breakage, delivery error or defective merchandise, you must send a written complaint by email to CARAT DIAMOND within 48 hours of delivery to our Customer Service Department at the following email address info@caratdiamond.ch
  • We accept no liability for damage during transport or damage caused by improper storage after the goods have been handed over to the transport company, to you (the customer) or to your auxiliaries.

RETURNS

• • You can return the goods that do not suit you within 5 days of receipt of the order.
  • CARAT DIAMOND only accepts returns of goods in good condition and in their original sealed packaging, accompanied by the invoice.
  • When returns have been made in the prescribed manner, CARAT DIAMOND will reimburse the price of the returned merchandise and the delivery costs invoiced within a maximum period of 30 days from the date of receipt of the returned merchandise. Shipping costs are your responsibility.

LIMITATION OF LIABILITY

• • The photos and texts illustrating and describing the products that appear on this site are non-contractual and for information purposes only. CARAT DIAMOND assumes no responsibility for errors or omissions in the photos or texts appearing on this site.

DATA PROTECTION

• • Your personal data will be collected exclusively in accordance with legal requirements and will be processed in accordance with our Privacy Notice.

FORCE MAJOR

• • CARAT DIAMOND will do everything possible to fulfill its obligations but cannot be held responsible for delays or non-delivery resulting from circumstances beyond its control, such as strikes, wars, natural disasters or others which prevent the production, transportation or delivery of products.
  • In case of delay, CARAT DIAMOND will fulfill its obligations as soon as possible and reserves the right to distribute the remaining stocks of products among its customers in an equitable manner.

VALIDITY OF THE GENERAL CONDITIONS OF SALE

• • Should any provision of these GTC be declared invalid or partially invalid, the validity and scope of the remaining provisions shall remain unaffected. Invalid conditions will be replaced by the applicable legal provisions of Swiss law.

APPLICABLE LAW AND FORUM

• • These General Terms and Conditions of Sale are subject exclusively to Swiss law. The Vienna Convention (CISG) is excluded. The exclusive legal venue is at the registered office of CARAT DIAMOND in Switzerland.
